(Oral) The applicant is in judicial custody in FIR No.87 of 2022, dated 16.11.2022, under Sections 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Kapkot, District Bageshwar. He has sought his release on bail. This is the second bail application of the applicant. His first bail application has already been rejected on 20.12.2023. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the applicant would submit that the entire prosecution case is false; witnesses have stated that the Inventory Report was prepared at the spot; it bears the FIR number and other details of the offence, which was lodged much after the alleged recovery. It is also submitted that the 2 Investigating Officer did not tell in the court, as to who recorded the FIR number and its details in the Inventory Report? 4. These facts are admitted by the learned State counsel. 5. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 6. The bail application is allowed. 7. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
