ORAL ORDER
This petition is filed by accused No.8 under Section 483 of BNSS praying to grant bail in Crime No.99/2025 of Jagajeevanaramnagar Police Station registered for the offence under Sections 103, 61(2), 189(2), 191(2), 191(3), 190 of BNS.
2. Heard learned counsel for petitioner and learned Additional SPP for respondent / State.
3. Learned counsel for the petitioner would contend that there are no overt acts alleged against this petitioner assaulting the deceased. The allegation against the petitioner is that he made posting in Instagram celebrating the death of deceased. The deceased was a rowdy sheeter. As the charge sheet is filed the petitioner is not required for custodial interrogation. Accused No.7 who is

similarly placed to that of this petitioner has been granted bail by this Court in Crl.P.No.13861/2025 by order dated
17.10.2025. With this he prayed to allow the petition.

Per contra, learned Additional SPP would contend that the petitioner by posting in his Instagram account celebrated the death of the petitioner and also stated that another person is going to be attacked. Petitioner is having criminal antecedents and involved in 10 cases and he is a rowdy sheeter. With these, she prayed to reject the petition.
5. Having heard the learned counsels, the Court has perused the charge sheet and other materials on record.
6. On perusal of column – 17 of the charge sheet, accused Nos.1 to 7 and Juvenile conspired to kill the deceased. In furtherance of the said conspiracy, accused Nos.1 to 5 attacked the deceased and caused injury due to which deceased died. There is no allegation of this petitioner present on the spot. The allegation against the

petitioner is that he made posting in his Instagram account celebrating the death of deceased. As the charge sheet is filed, the petitioner is not required for custodial interrogation. Considering the above aspect, the petitioner has made out case for grant of bail with conditions. In the result, the following:
ORDER
The petition is allowed. The petitioner is granted bail in Crime No.99/2025 of Jagajeevanaram Nagar Police Station, subject to following conditions: (i) The petitioner shall execute a personal bond for sum of Rs.1,00,000/- (Rupees one lakh) with one surety for the like-sum to the satisfaction of the trial Court. (ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iii) The petitioner shall attend the trial Court on all dates of hearing unless

exempted and co-operate for speedy disposal of the case. (iv) The petitioner shall mark his attendance in the jurisdictional police Station on 4th Sunday of every month, till disposal of the case registered against him.
