The learned counsel for the respondent would fairly submit that the distance and prejudice expressed by the petitioner/wife is no doubt acceptable but that cannot be a sole ground to entertain the transfer application, when the petitioner is able bodied and only 28 years old. 4. I have carefully considered the submissions advanced by the learned counsel on either side. 5. Admittedly, the transfer which is now sought for is to the Sub Court, Kanchipuram, where the presence of the parties is not mandatory and therefore, no serious prejudice would be caused to the respondent/husband, if the transfer request of the petitioner/wife is acceded to. 6. In the light of the above, the Transfer Miscellaneous Petition is allowed with the following directions:- (i) HMOP. No.586 of 2024 on the file of the Sub Court, Poonamallee is withdrawn and transferred to the file of Sub Court, Kanchipuram. https://www.mhc.tn.gov.in/judis TR CMP. No.1067 of 2025 __________ Page3 of 4 (ii) The Principal Sub Court, Kanchipuram shall not ordinarily insist on the presence both the petitioner and the respondent, except where their presence would be absolutely necessary for the purposes of their examination. (iii) The learned counsel for the respondent seeks expediting the proceedings before the Sub Court, Knacheepuram. Considering that the OP was filed way back in October 2024, in the light of the above, the learned Sub Judge, Kanchipuram, is directed to ensure that the pleadings are complete within a period of four (4) weeks from the date of receipt of the papers in the HMOP. No.586 of 2024 from the file of Sub Court, Poonamallee and thereafter, endeavour to expedite trial and dispose of the matter on merits and in accordance with law, by 31.03.2027. Consequently, connected Miscellaneous Petition is closed.
