1. While the matter was being argued, learned counsel for the petitioner was confronted with the maintainability of the instant petition.
2. The record reveals that the petitioner without taking legal recourse with reference to alleged facts, has chosen to file some representation before the Dy. Superintendent of Police, Headquarter District Kupwara, that too on 5th June, 2025. It appears that learned counsel for the petitioner has neither followed the procedure prescribed in the Bharatiya Nagarik Suraksha Sanhita, 2023, [‘BNSS Act] nor availed the appropriate remedy available under law
3. Confronted with the maintainability of the writ petition, learned counsel for the petitioner seeks withdrawal of the same with liberty to avail the appropriate remedy available under law.
4. Dismissed as withdrawn with liberty as prayed for.
