The present transfer petition has been filed under Section 24 of the Code of Civil Procedure for transfer of Original Suit No.84 of 2023 from the Court of learned Principal Judge, Family Court, Godda to the Court of learned Principal Judge, Family Court, Deoghar. 3. It has been submitted by the learned counsel for the petitioner/wife that there is already litigation pending in Deoghar. The wife has filed a complaint case under Section 498A of IPC. It has been further submitted that it will be convenient for wife and she apprehends that she may be mal treated. 4. On the other hand, learned counsel for the husband has submitted that the wife is a government Teacher and she has deserted the matrimonial home. On the ground of cruelty and desertion, divorce suit has been filed. 5. Considering the fact that the wife is a capable person and there is a good communication between Deoghar and Godda, this Court finds no reason to transfer the case from Godda to Deoghar.
