JUSTICE B.M.SHYAM PRASAD) The complainants are the petitioners in WP No.105102/2021 which is disposed of by the Writ Court on 15.11.2022 directing the Chief Officer, Navalgund Town Municipal Council (the first respondent) to consider the complainants’ representation within a period of two months from the date of receipt of the copy of the order. The complainants have filed their representations stating that their neighbouring is putting up construction in violation of the sanctioned plan. Sri B.V. Somapur, the learned counsel for the first respondent, has placed on record the compliance report dated 28.01.2025 along with copies of the proceedings under Section 187 of the Karnataka Municipality Act, 1964. As of the date of the compliance report, the proceedings were listed by the first respondent for orders and it is currently stated that such order is passed. In which event, especially with the first respondent detailing the different action taken - 4 - NC: 2025:KHC-D:1691-DB CCC No. 100389 of 2023 for conclusion of the proceedings after the Writ Court’s order, the complaint cannot be sustained and must be closed, but without prejudice to the complainants to avail the remedy the first respondent’s order if there is a cause for the same.
