Present petition has been filed aggrieved by the F.I.R No. 821/2023, charge-sheet and criminal case against the petitioners, criminal case No. 1638/2023, which is pending before J.M.F.C., Janjgir, District - Janjgir Champa, Chhattisgarh. 2. The petitioners have filed the present Criminal Miscellaneous Petition with the following relief: “It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this petition and quash/set aside the F.I.R No. 821/2023 and the also please to quash the Criminal Case No. 1638/2023, in the interest of Justice.” 3. Learned counsel appearing for the petitioners would submit that the charges have been framed against the petitioners in the matter, but the evidence has not been recorded, and the order framing charge has not been challenged in the present petition, as such they want to withdraw the present petition. 4. The submission made by learned counsel for the petitioners is not 3 opposed by the State counsel. 5. In view of the submissions made by learned counsel for the parties, that the charges have been framed in the matter, the present CRMP stand dismissed as withdrawn with the liberty to take recourse to challenge the order of framing charge, if so advised. 6. Registry is directed to return the certified copy of the annexures to the learned counsel for the petitioners after retaining the attested true copy of the same.
