This is an application filed at the instance of the Opposite Party-Appellant with a prayer to recall of order dated 10.12.2025. 3. Learned counsel for the Opposite Party at the outset contended that vide order dated 10.12.2025, this Court directed the Appellate Court to dispose of the appeal within a period of three months as a result of which, the learned Appellate Court is not providing enough opportunity of hearing to the Appellant-Opposite Party in the pending appeal. 4. Learned counsel appearing for the Petitioner-Respondent in the appeal on the other hand contended that the Appellant-Opposite Party is in no way affected by the order dated 10.12.2025 and that this Court by passing an order has directed the learned trial Court to Page 2 of 2. expedite the hearing of the appeal. On such ground, learned counsel for the Petitioner contended that the I.A. filed by the Opposite Party- Appellant is devoid of merit and the same is liable to be dismissed. 5. Having regard to the submissions made by the leaned counsels appearing for both sides, further on careful scrutiny of the order dated 10.12.2025, this Court is of the view the same does not call for any interference. However, while disposing of the I.A. No.247 of 2026, this Court makes it clear that while hearing the appeal the learned Appellate Court shall provide ample opportunity to both sides to put forth their case. 6. With the aforesaid observation/direction, the I.A. stands disposed of. Accordingly, the time to dispose of the appeal is extended by a further period of three months to be counted from today.
