Case No. 404 of 2023, for the offences registered under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 506 of the I.P.C., pending in the Court of Miss. Shikha Rani Tigga, learned J.M., 1st Class, Hazaribagh. On 16.09.2023, the petitioner alongwith co-accused persons are alleged to have assaulted the son of the informant namely Abhishek Kumar, due to which, he sustained injury. Learned counsel appearing on behalf of the petitioner has submitted that earlier, a case was filed against Abhishek Kumar, being Katkamsandi P.S. Case No. 403 of 2023, in which it is alleged that the injured Abhishek Kumar had attempted to rape the informant Kanti Devi, who is the wife of one of the co-accused. It was further submitted that police has not submitted charge-sheet under Section 307 of the I.P.C. but the learned Court below has taken cognizance under the said Section. It was further submitted that similarly situated co-accused has been granted bail by this court earlier vide B.A. No. 2013 of 2025. Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of Miss.
