QUASH THE AWARD DATED 02.02.2019 PASSED BY THE LABOUR COURT, CHIKKAMAGALURU, IN I.D.A.NO.01/2018 THE CERTIFIED COPY OF WHICH IS PRODUCED AND MARKED AS ANNX-J BY WHICH THE LABOUR COURT REJECTED THE CLAIM OF TH PETITIONER WHICH IS ARBITRARY, ILLEGAL AND UNCONSTITUTIONAL.
THE PETITION COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER
The writ petition is filed assailing the award dated 02.02.2019 in I.D.A. No.01/2018 on the file of Labour Court, Chikkamagaluru. The award is questioned by the workman.

Learned counsel for the petitioner and respondent are present.

Learned counsel for the petitioner/workman and the
learned counsel for the respondent-Corporation jointly submit
3 that the dispute is settled and the parties have reduced the terms of the settlement in the joint memo.
4. The joint memo reads as under:-
"JOINT MEMO The WP filed against the award in IDA.No.01/2018 dated 2.2.2019 on the file of the Labour Court, Chikkamagalur has been settled between the parties on the following terms and the award may kindly be modified as under:
1. The Respondent Corporation to reinstate the petitioner - workman into service without continuity of service, without consequential benefits, without backwages from the date of dismissal till the date of actual reinstatement by withholding two annual increments with cumulative effect.
2. Pending default cases if any which are filed will be reopened.
3. The parties to the proceedings have agreed for the above terms."
5. The joint memo is taken on record.

6. This Court has perused the terms of the settlement. This Court does not find any impediment to accept the terms of the settlement. Accordingly, the impugned award dated 02.02.2019 in I.D.A. No.01/2018 on the file of Labour Court, Chikkamagaluru is modified in terms of the joint memo.
