2. The petitioner has been made accused in connection with Garhwa P.S. Case No. 548 of 2024 corresponding to POCSO Case No. 09 of 2025, for the offences registered under Sections 137(2), 3(5) of the B.N.S. Later on, Section 64 of the B.N.S. and Section 6 of the POCSO Act was added. The case is pending in the Court of learned Special Judge POCSO-cum-ASJ-I- cum-FTC(CAW), Garhwa.
3. On 16.10.2024, at about 06:00 a.m., 17 years old daughter of the informant went missing. After she was recovered, her statement was recorded under Section 183 of the B.N.S.S., in which she has stated that the petitioner by threatening to kill her brother and her family members, took her to different places. She has also stated that the petitioner has raped her.
4. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
