Order No. 05/ Dated: 20th June, 2025
1. Heard learned counsel for the parties.
2. This transfer petition has been filed for transfer of Original Matrimonial Suit No. 17 of 2024 from the Court of Principal Judge, Family Court, Gumla to Principal Judge, Family Court, Ramgarh.
3. Learned counsel for the petitioner submits that petitioner is a lady, left by her husband/opposite party, without any reasonable cause. Her marriage was solemnized on 11.12.2020. After marriage, the opposite party and his family members started demanding dowry and on non- fulfillment of the same, she was assaulted by them.
4. It is further submitted that opposite party (her husband) has filed Original Matrimonial Suit No. 17 of 2024 under Section 9 of the Hindu Marriage Act in the Court of Principal Judge, Family Court, Gumla.
5. It is also submitted that the petitioner is unable to contest the case instituted by her husband at Gumla as being a lady she is unable to travel from Ramgarh to Gumla. She has also not any independent source of income and presently she is unemployed, therefore, the Original Original Matrimonial Suit No. 17 of 2024 pending before the Court of learned Principal Judge, Family Court, Gumla may be transferred to the Court of Principal Judge, Family Court, Ramgarh.
