MARIA CLETE, J These petitions have been filed to condone the delay of 2041 days in filing the application to set aside the abatement of R2, to set aside the abatement of R2 and to bring on record the legal heirs of R2. 2.Heard the learned counsel for the appellant. It is seen from the affidavit filed in support of these petitions that the appellant counsel has come on change of vakalat and death of R2 was informed belatedly and hence, the delay occurred, is neither wilful nor wanton. 3.Mr. N. Mohamed Ibrahim, learned counsel who held vakalat for R2 submits that he has got no serious objection in allowing these petitions and undertakes to file vakalat for the proposed respondents. 4.Considering the reasons stated in the affidavit filed in support of these petitions, these petitions are allowed.
