JUSTICE DR. ANSHUMAN ORAL ORDER 3 09-04-2025 Heard learned Counsel for the petitioner and learned APP for the State. 2. The petitioner is apprehending arrest in connection with N.T.P.C. Khaira P.S. Case No. 94/2023 registered on 03.11.2023 for the offenses punishable under Sections 147, 149, 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code, pending before the learned ACJM-III, Aurangabad. 3. According to the prosecution, F.I.R. has been lodged against four accused persons, including the petitioner, alleging that all the accused, including the petitioner, assaulted the informant with a lathi, danda, farsa, rod, and pistol, causing injuries to various parts of the informant’s body, including the head. It is specifically alleged that co-accused Vicky Singh and Nicky Singh snatched a gold chain and a gold ring, while co- accused Mangal Singh and the petitioner assaulted the informant

It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. The petitioner has falsely been implicated in this case due to enmity. The allegation levelled in the F.I.R. is completely false and fabricated. The antecedent of the petitioner is clean. 5. Learned APP for the State vehemently opposes the prayer for bail. 6. In this background, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with N.T.P.C. Khaira P.S. Case No.94/2023, pending before the learned A.C.J.M. III, Aurangabad, is hereby rejected. 7. However, it is directed that the petitioner shall surrender before the Trial Court within a period of four weeks from today.
In case the petitioner surrenders within this period, the Trial Court is directed to pass an order on his surrender-cum- bail application on the same day, without being prejudiced by the fact that the petitioner’s anticipatory bail has been rejected by this Court. Ashwini/- (Dr. Anshuman, J) U T
