ORAL ORDER
This petition is filed by accused Nos. 1 to 5 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.162/2025 of Piriyapatna Police Station registered for offences punishable under Sections 318(4), 336(2), 336(3), 340(2) of BNS.
2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent -State.

Learned counsel for the petitioner would contend that the name of husband of petitioner No.1 and father of petitioner Nos. 2 to 5 is Annaiah and he was having ancestral property in Thathanalli Village. On the death of said Annaiah the petitioners have filed application for entry of their name as legal heirs of the said Annaiah. The name of the complainant is also Annaiah and his father's name is Mottaiah. There was no any intention on the part of the petitioners to grab the property of complainant. The petitioners are ready to co-operate with

the police in the investigation and abide by any conditions to be imposed by this Court. The offences alleged against the petitioners are not punishable either with death or imprisonment for life. With this, he prayed to allow the petition.

Per contra, learned High Court Government Pleader for the respondent –State would contend that petitioners by using the name of Annaiah, who is not the son of Mottaiah gave false affidavit that father of Annaiah is both named as Mottaiah and Doddaiah filed application seeking entry of their name as legal heirs of Annaiah. Offences alleged against the petitioners are heinous offences. Petitioners are required for custodial interrogation. With this he prayed to reject the petition.
5. Having heard learned counsels, the Court has perused the FIR, complaint and other materials placed on the record.
6. Petitioners being the wife and children of Annaiah had filed an application to enter their name as

legal heirs of Annaiah son of Doddaiah stating that the said Annaiah’s father Doddaiah is also called as Mottaiah. Whether the petitioners are intended to grab the property of the complainant is matter of investigation and trial. The offences alleged against the petitioners are not punishable either with death or imprisonment for life. The petitioners are not having any criminal antecedents. The petitioners all are women. Considering the above aspects, the petitioners have undertaken to cooperate in investigation and abide by conditions to be imposed by this Court. Considering the above aspects, the petitioners have made out case for grant of anticipatory bail with conditions.
7. In the result, the following
ORDER i) The petition is allowed. ii) The petitioners are ordered to be released on bail in the event of their arrest in Crime No.162/2025 of Piriyapatna Police Station subject to following conditions:

a) Petitioners –accused Nos.1 to 5 shall voluntarily appear before the Investigating Officer within 15 days from this day and execute bail bond for a sum of Rs.1,00,000/- each with one surety for the likesum to the satisfaction of the Investigating Officer.
b) Petitioners –accused Nos.1 to 5 shall cooperate with the police in the investigation and appear before the Investigating Officer whenever called for.
c) Petitioners –accused Nos.1 to 5 shall not directly or indirectly make an inducement or threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such a facts to the court or police officer or tamper with the evidence.
