SURESH REDDY CRIMINAL PETITION No. 1817 of 2025 ORDER: As per the directions of My Lord the Hon’ble the Chief Justice, this Criminal Petition has been allotted to this Bench by notice dated 25.3.2025 and the same is treated as part of the roster effective from 26.3.3025. 2. This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’), is filed by the petitioner/Accused, seeking anticipatory bail, in Crime No.40 of 2022 of Prathipadu Police Station, Guntur Urban District, registered for the offence punishable under Sections 420 and 403 IPC. Subsequently the offences under Sections 120-B, 419, 465, 466, 468 and 471 r/w 34 IPC have been added. 3. The case of the prosecution is that D. Ravi Kumar being Ex-Branch Manager of Guntur District Central Cooperative Bank, Prathipadu branch had illegally and with a mala fide intention introduced some of his relatives and friends as farmers and he himself processed their loan applications by creating Revenue Records and created bonds at Sub-Registrar office and sanctioned 2 loan amount and credited the same in their Savings Accounts by misusing his power. He later withdrew those loan amounts from the bank accounts and purchased immovable properties in his name and also in the name of his son and wife. Thereafter he confessed his misdeeds before CEO and other officials of GDCCB and further assured that he will repay the amounts within one month. Now he is absconding. On the basis of said allegation the present crime has been registered. 3. Learned counsel for the petitioner submits that the petitioner is a retired Tahsildar and that he was falsely implicated in the present case only based on the confession of other accused. He further contends that the petitioner is suffering from heart ailment and presently he is taking treatment as inpatient in a private hospital at Vijayawada. He further contends that he was arrested in Crime No.182 of 2024 of Prathipadu Police Station, Guntur District and he was released on bail. Hence, he requests this Court to grant anticipatory bail to the petitioner. 5. On the other hand, the learned Additional Public Prosecutor opposed the bail application contending that the petitioner was involved in four (4) similar cases. 3 6. Be that as it may, since the petitioner was already retired from service and as he is taking treatment in hospital for heart ailment and as he was already arrested in another crime and was granted bail, this Court is inclined to grant anticipatory bail to the petitioner/Accused on certain conditions. 7. In the event of his arrest, the petitioner is directed to be released on bail on his furnishing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each, to the satisfaction of Station House officer, Prathipadu Police Station, Guntur Urban District. On such release, the petitioner/Accused is directed to cooperate with the Investigating Officer and also directed not to tamper with the prosecution witnesses in any manner. 8.
