Neutral Citation No. - 2025:AHC:144322 Court No. - 69 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 6041 of 2025 Applicant :- Suraj Kumar Gour Alias Suraj Gour Opposite Party :- State of U.P. Counsel for Applicant :- Awanish Kumar Pandey,Shishir Kumar Dwivedi Counsel for Opposite Party :- G.A. Hon'ble Vivek Varma,J.
1. Copies of medical reports and supplementary medical reports of four injured along with the statement of doctor produced by learned AGA, are taken on record.
2. Heard learned counsel for the applicant, Sri V.P.Tripathi, learned A.G.A. for the State-opposite party, and perused the record.
3. This application has been filed seeking anticipatory bail in Case Crime No. 255 of 2025, under Sections 191(2), 191(3), 190, 115(2), 118(1), 117(2), 109, 110, 309(6), 352 B.N.S., Police Station Khorabar, District Gorakhpur.
4. Counsel for the applicant submits that on account of enmity the applicant has been falsely implicated in the instant case. The applicant has no criminal antecedents. It is next contended that the investigation is going on and the applicant has apprehension of his arrest in the above mentioned case.
5. Learned AGA has opposed the prayer for anticipatory bail.
6. Having heard learned counsel for the parties and having perused the record, this Court prima facie finds that as per the prosecution case, the applicant along with eight named accused and 3-4 unknown persons, with the intention to cause death, assaulted four persons namely Nitesh Kumar, Savindra Kumar @ Pappu, Amit Kumar and Geeta Devi. As per the medical reports, supplementary medical reports as well as statement of the doctor, the injured persons sustained grievous injures on vital parts of the body. The prosecution version is supported by the statement of the informant and the injured witnesses. The medical examination reports of the injured persons also corroborates the prosecution case. In my opinion, this is not an appropriate case for grant of anticipatory bail. Hence the application is hereby rejected, leaving it open to the applicant to apply for regular bail before the concerned court, which application when filed, may be considered on its own merits, without being prejudiced by any observation made in this order.
