The present petition has been filed for the following reliefs: "a) Issue an order or direction to the the Court concerned to heard and decide the Case No. 151 of 2014 (Ramesh (since deceased) Vs. Smt. Annpurna Mishra & Others) expediousely within stipulated time, fixed by this Hon'ble Court, as soon as possible which is pending in the Court of Civil Judge (J.D.) Ghazipur. b) Issue an order or direction to the defendants/respondents, not to create third party right or interest over the property in dispute, otherwise the plaintiffs/petitioners shall suffer irreparable loss and injury." 2. From perusal of the writ petition it appears that the suit is pending since 2014 and from perusal of the order sheet, annexed as Annexure No. 1 to the petition, it appears that several dates have been fixed by the Court concerned, however, till date, the aforesaid suit has not been decided. 3. No useful purpose would be served in keeping this petition pending. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to Civil Judge (J.D.) Ghazipur to decide the aforesaid suit, in accordance with law, expeditiously, after hearing all the concerned parties and giving a reasonable opportunity of leading evidence in respect of their case provided there is no other legal impediment.
