Heard Sri Dileep Kumar Srivastava, learned counsel for the petitioner, Sri Navin Chandra Srivastava, learned counsel for the respondent Nos.3 and 4, and learned Standing Counsel for the State-respondents. 2. The prayer made in the instant petition is for issuing a writ of mandamus, commanding despondent No.2 i.e. Regional Passport Officer, Lucknow to issue passport to the petitioner on the basis of his application registered as File No. (ARN) 230000502078 within stipulated time. 3. Sri Navin Chandra Srivastava, Advocate has appeared on behalf of respondent No.3 and 4 and states that petitioner was issued a notice on 15.02.2023 regarding pendency of criminal case against him, but no response has been received from him till date. It is further stated that in case any no objection certificate is filed by the petitioner in terms of the judgment in (Pawan Kumar Rajbhar vs. Union of India and 2 others) further action would taken accordingly. 4. It has been held by a Coordinate Bench in Writ-C No. 41540 of 2023 (Pawan Kumar Rajbhar vs. Union of India and 2 others) and other connected matters decided on 19.01.2024 that in such an event, it is open to the person concerned to seek no-objection from the jurisdictional criminal court in respect of grant of passport and the Regional Passport Officer shall act, accordingly. 5. In view of the aforesaid position, we dispose of the writ petition with liberty to the petitioner to apply before the concerned court for no-objection and in case, the same is granted, the Regional Passport Officer shall proceed to take further action in the matter taking into notice the no-objection granted by the court.
