3 CAV JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) The Writ Petition No.7176/2020 (S-PRO) had been filed challenging an endorsement issued by the respondent dated 08.05.2019 and seeking directions to the respondent to promote the petitioner to the post of Superintending Engineer (R & D) as also to grant study leave benefits from 2000 to 2003. The writ petition was dismissed on 06.12.2023 holding that the Cadre and recruitment Rules specifically provided for completion of 5 years of service as Executive Engineer for being considered for promotion to the post of Superintending Engineer (R & D). It was found that there is no provision to promote a person solely on the basis of acquisition of a Ph.D. qualification.
2. The Review Petitioner filed W.A.No.541/2024, which was also dismissed by the judgment under review. It was found that the petitioner's seniority was still at Sl.No.17 when he retired from service and he did not have the five year service as Executive Engineer required for promotion to the post of Superintending Engineer. It was also found that

4 Ph.D. degree obtained by him after 13 years would not entitle him to claim any additional benefit in the matter of seniority or promotion. The writ appeal was dismissed on
01.08.2025.
3. The present Review Petition is filed stating that several aspects of the matter have not been taken into account by the Division Bench while deciding the matter.
4. The Review Petitioner/Party-in-Person has placed the decision of the High Court of Judicature for Rajasthan Bench at Jaipur:- • Heera Lal Saini and Another v. State of Rajasthan and Others, by
Order dated 06.11.2025 passed in S.B. Civil Writ Petition No.19073/2024.
5. Though the Review Petitioner/Party-in-Person has placed reliance on several documents in support of his
contentions, we notice that there is no ground made out to review the judgment. The review of a judgment is liable to be undertaken only if there is a mistake or error which is apparent in the judgment or if knew an important evidence

5 which was not in the petitioner's knowledge is discovered or for such other sufficient reasons. Apart from reiterating the
contentions made in the writ petition and the writ appeal, no ground for reviewing the judgment is made out by the petitioner.
6. It is a trite law that a review petition cannot be an appeal in disguise and reconsideration of the facts and law argued in the original proceedings cannot be undertaken in a review.
7. The judgment relied on by the review petitioner also does not lay down any proposition that the Review Petition, which is filed reiterating the contentions made in the writ petition as well as the appeal, requires any
consideration.
8. Having considered the contentions advanced, we are of the opinion that there is no error apparent that requires any correction in the review. The review petition fails, the same is accordingly dismissed.
