ORAL ORDER Heard learned counsel for the petitioner and learned Additional SPP for the State. Perused the material on record. 2. Petitioner - sole accused in Crime No.159/2025 of Tumkur Rural Police Station registered for the offence punishable under Section 108 of BNS, 2023, has preferred this petition under Section 483 of BNSS 2023, to enlarge him on bail. 3. It is the case of prosecution that petitioner and the deceased were in love with each other. On 23.06.2025 at about 10.00/10.15 p.m., petitioner came near the house of the deceased, picked up quarrel with her regarding their marriage, instigated her to go and die, on account of which, deceased committed suicide by hanging herself with a saree tied to the window. - 3 -

4. The complaint is lodged by the mother of deceased. The complaint averments reveal that her daughter Chaitanya was pursing her studies in one Siddartha College and for the last two years, she was in love with the petitioner. It is averred in the complaint that on 23.06.2025 at about 10.15 p.m., her sister-in-law - Smt.Prabhavathi came near her house along with the petitioner and informed that her daughter Chaitanya has committed suicide. Since the door was locked, they broke open the door and went inside and saw the deceased in a hanging position. 5. It is alleged that the petitioner who came near the house of the deceased, while talking to her from outside through the window, picked up quarrel with her and instigated her to go and die. 6. Learned Additional SPP contended that CW-2/Smt. Prabhavathi was very much present at the spot, when the incident took place and her statement clearly reveal that

the petitioner has picked up quarrel with the deceased and told her to go and die, due to which, she has committed suicide. She therefore, contended that the ingredients of the offence alleged are made out, hence, there is a prima- facie case against the petitioner. 7. A perusal of the material on record goes to show that the deceased and the petitioner were in love with each other for the past two years.
Further, it is the petitioner and Smt. Prabhavathi, sister-in-law (CW-2) of the complainant who informed the complainant that her daughter has committed suicide. It is also seen that the room where deceased committed suicide was locked from inside and complainant, CW-2 and the petitioner broke open the door, by that time, the deceased had hanged herself. 8. The prosecution has to establish during trial that the petitioner has intentionally aided or abetted the deceased to commit suicide. Petitioner has no bad antecedents. - 5 -

Investigation is completed. He was arrested on
24.06.2025. He has been interrogated. In the facts and circumstances, without expressing any view on the merits of the case, petitioner can be admitted to bail. Accordingly, the following:
ORDER Petitioner/accused in Crime No.159/2025 of Tumkur Rural Circle Police Station, shall be enlarged on bail, subject to following conditions:
1. Petitioner shall execute a personal bond for a sum of `50,000/- (Rupees fifty thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address.
3. He shall not leave the jurisdiction of the trial Court without prior

permission of the learned Sessions Judge.
4. He shall not tamper with the prosecution witnesses either directly or indirectly.
5. He shall appear before the trial Court on all dates of hearing without fail. Violation of condition/s shall result in cancellation of bail. Sd/- (MOHAMMAD NAWAZ) JUDGE
