Having heard learned counsel for the parties and considered the issue in hand in the light of material on record, we are of the considered opinion that though the appellant cannot be absolved of his liability to pay exemplary costs, yet in the given facts and circumstances we scale down the costs to Rs. 20,000/- . 3. It is reported that the appellant has deposited Rs. 40,000/- in the Registry of this Court. 4. Registry shall refund an amount of Rs. 20,000/- to the appellant after due verification. 5.
