The instant petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS, 2023) has been filed for issuance of directions for expeditious disposal of the case bearing No.CHI-1337-2019 titled as ‘State of Haryana Vs. Rahul’ pending before the Chief Judicial Magistrate, First Class, Bhiwani in FIR No.217 dated 06.08.2018, under Sections 323, 406, 498-A & 506 IPC, registered at Police Station Bawani Khera, District Bhiwani. 2
Learned counsel for the petitioner inter alia submits that the abovesaid FIR was registered against the petitioner and other accused persons. Thereafter, charges were framed against the petitioner on 24.01.2020 and the case was adjourned and out of a total of 09 prosecution witnesses, till date only 01 witness has been examined. He further submits that the petitioner is regularly appearing before the learned trial Court on every date of hearing and the trial of case is pending since 6 ½ years. issued to the learned trial Court concerned to conclude the trial within a period of six months. 3

In view of the limited prayer made by the petitioner and considering the fact the trial is pending since 6 ½ years, the present petition is disposed of with a direction to the learned Chief Judicial Magistrate, First Class, Bhiwani to make an endeavour to conclude the trial of case bearing No.CHI-1337-2019 titled as ‘State of Haryana Vs. Rahul’ in FIR No.217 dated 06.08.2018, under Sections 323, 406, 498-A & 506 IPC, registered at Police Station Bawani Khera, District Bhiwani, expeditiously, preferably within this year.

disposed of.
