JUSTICE CHANDRA SHEKHAR JHA ORAL JUDGMENT Date : 06-05-2025 Heard learned counsel for the petitioner, learned APP for the State duly assisted by learned counsel appearing for O.P. No.2. 2. Initially, this petition was preferred to quash the order dated 21.09.2024 passed by learned Sessions Judge, Vaishali at Hajipur in Criminal Misc. Case No.69 of 2023, whereby the learned Sessions Judge has cancelled the bail bond of the petitioner but, subsequently, I.A. No.2 of 2025 has been preferred to amend the prayer to quash the entire criminal proceeding initiated against the petitioner in Patna High Court CR. MISC. No.77260 of 2024 dt.06-05-2025 2/7 connection with Complaint Case No.2443 of 2020 instituted for the offences punishable under Sections 498-A and 406 of the Indian Penal Code (in short ‘I.P.C.’) for the reason that during the pendency of proceeding, parties have compromised their dispute and differences. 3. The case of prosecution as per complainant/O.P.No. 2, namely. Dr. Anuradha is that she married Dr. Rajeev Ranjan on 30.01.2011 as per Hindu customs, while she was a BDS student in Mumbai and the petitioner was a Senior Resident at AIIMS, Delhi. Her family spent Rs. 22.5 lakhs on the wedding, and it was agreed that she would pursue PG course in Mumbai with financial support of her husband. Informant further alleged that neither the petitioner nor his family provided any financial or emotional support rather her jewellery was kept by her in-laws, shortly after marriage. Her husband repeatedly avoided living with her, citing work postings in Vadodara, Bhubaneswar, and Patna, and eventually asked her to arrange Rs. 15 lakhs from her father to buy a flat, saying that she couldn’t stay in government quarters. Despite completing her PG in 2019, the Patna High Court CR. MISC. No.77260 of 2024 dt.06-05-2025 3/7 complainant was denied entry to both the houses that is her husband’s and in-laws’ residences. Repeated efforts by her and her parents were made to reconcile the issue but was unsuccessful and even she was blocked by her husband on mobile. The in-laws allegedly abused and threatened her and her belongings were never returned. She further alleged that her husband never established physical relationship, suspecting qua her husband of either infidelity or impotency and due to this, the informant has suffered mental trauma and depression. 4. It is submitted by learned counsel appearing for the petitioner that the matter has been compromised between the parties against one-time alimony of Rs.55,00,000/- (Rupees Fifty-five Lakhs), which was duly paid and received by O.P. No.2, namely, Dr. Anuradha. It is submitted that the parties have also dissolved their marriage amicably under Section 13-B of the Hindu Marriage Act, 1955, which is apparent from the judgment of learned Principal Judge, Family Court, Vaishali as passed in Divorce (Matrimonial) Case No.540 of 2024 dated 20.02.2025. It is pointed out Patna High Court CR. MISC. No.77260 of 2024 dt.06-05-2025 4/7 that in view of aforesaid, continuing of present criminal complaint before the court below would only amount to abusing the process of the court of law and, therefore, the same be set aside/quashed. 5. Learned counsel appearing for O.P. No.2 also affirmed the factum of compromise as submitted above by learned counsel appearing for the petitioner. It is submitted that he has no objection if the criminal complaint as aforesaid be quashed in view of the compromise. 6. In view of aforesaid, it appears that the matter appears compromised between the parties, where O.P. No.2 has received Rs. 55 Lakhs as one time alimony. Their marriage also appears dissolved mutually, accordingly, continuing with aforesaid criminal proceedings would only Patna High Court CR. MISC. No.77260 of 2024 dt.06-05-2025 7/7 amount to abusing the process of court of law and, therefore, the entire criminal proceedings in connection with Complaint Case No.2443 of 2020 with all its consequential proceedings pending before the learned A.C.J.M.-X, Vaishali at Hajipur qua petitioner along with other co-accused is hereby quashed/set aside to secure the ends of justice. 8. The application stands allowed. 9. The interlocutory application(s), if any, stand disposed of in view of aforesaid judgment. 10.
