According to petitioner, he is permanent resident of village Gorakhpur, Bhimtal, District Nainital. He constructed a residential house. The Secretary, District Level Development Authority passed a demolition order against him on 05.11.2024. Petitioner preferred Appeal against the demolition order. His appeal has been dismissed by Commissioner, Kumaon Mandal, Nainital, vide order dated 28.05.2025. Thus feeling aggrieved, petitioner has approached this Court. 3. Learned counsel for the petitioner submits that petitioner is not financially well-off and he had constructed a dwelling unit to meet the residential needs of his family and the site where construction was raised is within a revenue village, which has recently been included in the development authority and being a villager, petitioner is entitled to a lenient approach in the matter. 2025:UHC:8353 4. Mr. Sandeep Kothari, learned counsel appearing for Development Authority submits that if petitioner makes application for compounding, his case shall be considered sympathetically. 5. In view of the assurance given by Mr. Kothari, writ petition is disposed of by permitting the petitioner to submit compounding map within four weeks. If petitioner submits compounding map within the stipulated time, the competent authority in the Development Authority shall examine his case and take appropriate decision, as per law, within eight weeks thereafter. 6. For a period of four months, status quo, as on today, shall be maintained qua the structure in question.
