GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 2 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 2nd respondent in insisting the petitioners to vacate from their wholesale vegetable shop Nos.7, 9, 13, 32, 63, 65, 69, 85, 86 and 99 situated at Sri Damodara Sanjevayya Vegetable Market, Ongole, Prakasam District, as illegal, irregular, irrational, without jurisdiction and violative of Articles 14 and 21 of Constitution of India and consequently direct the respondents not to interfere in any manner with the petitioners said vegetable wholesale shops as well as business ….” 2. Heard learned counsel for the petitioners, learned Government Pleader for Municipal Administration and Urban Development for respondent No.1 and Mr.A.S.C.Bose, learned Standing Counsel for respondent No.2. 3. During the course of hearing, learned counsel for the petitioners would submit that the issue involved in this Writ Petition is squarely covered by the order dated 11.02.2025 passed by this Court in W.P.No.3576 of 2025 and requested to pass a similar order in this Writ Petition also. The same is not disputed by the learned counsel appearing for the respondents. The operative portion of the said order, reads as under: “….The respondent authorities are directed not to interfere with the peaceful possession of the petitioners’ subject vegetable shop Nos.46 and 56 situated at Sri Damodara Sanjeevayya Vegetable Market, Ongole, Prakasham District without following due process of law.” 3 4. In view of the same, for the reasons alike in the aforesaid order, this Writ Petition is also disposed of by directing the respondent authorities not to interfere with the peaceful possession of the petitioners’ subject vegetable shop Nos.7, 9, 13, 32, 63, 65, 69, 85, 86 and 99 situated at Sri Damodara Sanjeevayya Vegetable Market, Ongole, Prakasham District without following due process of law. 5. Registry is directed to attach the copy of the order, dated 11.02.2025 passed by this Court in W.P.No.3576 of 2025 to this order. No order as to costs.
