A perusal of the affidavit filed by Sri Prabhakar Tripathi, the then Sub- Divisional Magistrate, Fatehpur, reveals that in paragraph no. 7 of his affidavit, he has admitted that the fact that while passing the order dated 07.06.2024, no notice was issued to Shah Hussain, the revisionist herein. 2. Under the circumstances, the order dated 07.06.2024 passed by the learned Sub-Divisional Magistrate, Fatehpur, is hereby quashed directing to Sub-Divisional Magistrate concerned to passed an order afresh while affording reasonable opportunity to the parties concerned. 3. The revision is allowed. 4. It is made clear that no opinion has been expressed on the merits of the case.
