At the very outset, learned counsel for the appellant submits that he does not press the instant application in view of the fact that during the pendency of the Regular Second Appeal, the impugned judgment and decree stands satisfied. He further submits that even the execution application filed by the decree-holder has since been dismissed as withdrawn being fully satisfied, vide order dated 27.05.2026. In the backdrop of these subsequent developments, learned counsel for the applicant prays for preponement of the main case from 11.08.2026 to enable him to withdraw the same. In view of the above, the present application is disposed of as not pressed; and hearing of the main case is advanced from 11.08.2026 to today and with the consent of learned counsel for the appellant, is taken on board.
