The appellant has preferred this appeal against the order dated 04.10.2025 in Crl.Misc.No.737/2025 passed by the II Additional District and Sessions Judge, Kolar. 2. The brief facts leading to this appeal are that on the basis of complaint filed by one Dinesh Kumar B, Masti Police Station have registered the case in Crime No.130/2025 against one Govinda and other four persons (names not known), for the offences under sections 103(1) and 109(1) of BNS, 2023. - 3 - HC-KAR NC: 2025:KHC:42549 CRL.A No. 2062 of 2025 3. Subsequently, on the basis of remand application, the concerned Police have registered the case under Section 3(2)(v) of SC/ST (POA) Amendment Act, 2015. 4. The appellant was arrested by the police on 14.08.2025. Since the date of arrest, the accused/appellant is in Judicial Custody. Bail application was filed before the Trial Court under Section 483 of Cr.P.C, the same was rejected. Hence, the appellant has preferred this appeal. 5. Learned counsel for the appellant would submit that, the name of the accused is not found in the First Information Report. The contents of First Information Report reveals that accused No.1 - Govinda and other four persons were involved in the alleged crime. However, after investigation, the Investigating Officer has submitted charge sheet against accused 1 to 8, for offences under sections 103(1) and 109(1) of BNS, 2023. - 4 - HC-KAR NC: 2025:KHC:42549 CRL.A No. 2062 of 2025 6. The entire allegation is that, accused 1 to 6 have assaulted the deceased Rakesh with deadly weapons and also assaulted the injured Karthik. It is alleged by the prosecution that, this appellant had taken a child in conflict with law on his two-wheeler thereby, he had shared a common object. On all these grounds, he sought for allowing this appeal. 7. Per contra, learned High Court Government Pleader Sri B.Lakshman submitted that there are prima facie materials to show that the alleged commission of offences are heinous in nature, punishable with death or imprisonment for life. If the accused is released on bail, he may threaten or tamper the prosecution witnesses. On all these grounds, he sought for rejection of this application. 8. My answer to the above points, as under: i) Affirmative ii) As per final order. Regarding Point No.1 10. I have examined the materials placed before this Court. On the basis of complaint filed by one Dinesh Kumar.B, Masti Police Station have filed case in Crime No.130/2025 against one Govinda and four others for the offences under sections 103(1) and 109(1) of BNS, 2023. After investigation, the Investigating Officer has submitted the charge sheet against accused 1 to 8 for the offences under sections 103(1) and 109(1), 238 R/w 190 of BNS and Section 3(2)(v) of SC/ST (POA) Act, 1989. 11.
