Issue a writ, order or direction in the nature of Certiorari quashing the order, dated 06/06/2025 passed by the Sub Divisional Officer, Tehsil Sadar, District Ballia in Suit No. 66 of 2017 (Zahir and others versus Radheshyam and others) (Annexure No. 1)." The prayer made in the writ petition cannot be granted at this stage as declaratory suit under Section 144 of U.P. Revenue Code, 2006 is still pending consideration. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to private respondents, the matter is being disposed of, at the admission stage, with a direction upon authority concerned to decide the declaratory suit filed under Section 144 of U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of six months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
