1. Mrs. Reema Rana, learned counsel for the applicant.
2. Mr. V.S. Pal, learned A.G.A. for the State.
3. The present applicant ‘Mang Singh @ Maan Singh @ Mangu’ is praying for bail in relation to First Information Report dated 22.02.2025 beraing FIR No. 08 of 2025, wherein the present applicant along with one Kuldeep Joshi @ Vijay Joshi @ Farishta has been implicated for the offence punishable under Section 2/3 of U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, P.S. Ritha Sahib, District Nainital.
4. It is contended by the learned counsel for the applicant that based on six pending cases against the applicant the applicant has been implicated, though in all those cases the applicant have already been enlarged on bail. She further submits that the applicant have no nexus with the gang leader.
5. Apart from this, she argued that the applicant’s wife is no more and there is 7 years old daughter, who is suffering from heart disease since last 5 years and no one is in the family to lookafter except the old aged mother, therefore, be enlarged on bail.
6. On the other side, learned A.G.A. Mr. V.S. Pal submits that keeping in view of the pending criminal cases against the applicant in which most of the cases relates to NDPS, it is not proper to enlarge the applicant on bail but keeping in view that 7 years old daughter is suffering from heart disease he may be granted short term bail.
7. The submission as advanced by the learned A.G.A. is really appreciable.
8. On this, learned counsel for the applicant submits that let this bail application be treated as
2025:UHC:5194 short term bail application and the applicant be enlarged on short term bail so that he may facilitate for giving good medical treatment to his daughter.
9. After hearing the arguments of learned counsel for the parties and further taking into
consideration the statement as given in the bail application that the applicant’s minor daughter is suffering from heart disease and there is no one in the family except the mother of the applicant to lookafter, this court is of the view that the present bail application is converted to short term bail application.
10. The same is, accordingly, converted to the short term bail application.
11. In view of the submission as advanced above particularly that the applicant’s daughter is suffering from heart disease, this court is of the view that the applicant deserves for short term bail for a period of three months.
12. Accordingly, without expressing any opinion on the merit of the case the applicant is admitted to short term bail.
13. Let the applicant ‘Mang Singh @ Maan Singh @ Mangu’ be released on short term bail for three months to be reckoned from the date of release on furnishing his personal bond and two sureties of the like amount to the satisfaction of the Court concerned subject to the condition that after being released he will surrender on expiry of term of short term bail, failing which the C.J.M. concerned shall issue necessary warrant.
