The petitioner is holding account with the 2nd respondent/bank bearing Account No.39969986219. While being so, the petitioner had committed an offence in Crime No.138 of 2025 and the petitioner was also arrested and remanded to the judicial custody along with Gutka Dealers. There is clear apprehension of the petitioner that he is no way connected with alleged crime and he obtained a home loan and it was also deposieted in his savings bank account. The allegation in complaint is that the petitioner aided in smuggling tobaccoe produced in Vadalur Area, which is totally false. Based on the said complaint, the 1st respondent requested the 2nd respondent to freeze the petitioner’s account and did not permit the petitioner to operate his account. 2/6 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.1168 of 2025 3. The learned counsel appearing for the petitioner submits that the petitioner availed home loan and the same was disbursed into the petitioner’s Savings Bank Account and it is lying in his Savings Bank Account and he would not able to transfer the same to the developer for the past one year. 4. On perusal of records, would reveal that there is no piece of evidence produced by the petitioner that the amount, which is lying in the petitioner’s bank namely on the file of the 2nd respondent, is the loan amount which was already disbursed in favour of the petitioner and deposited in the petitioner’s Savings Bank Account. That apart, the petitioner is being an accused in Crime No.138 of 2025 and facing investigation for the offences under Sections 286, 123, 336(2), 336(3) and 340(2) of BNS read with Sections 24(1) and 6(b) of the Cigarette and Other Tobacco Products Act, 2003. Now, the investigation is still pending. 5. Accordingly, the Writ Petition (Criminal) is dismissed. However, the 1st respondent is directed to completed the investigation in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.
