JUSTICE M.I.ARUN ORAL ORDER 1. The petitioners (accused) and respondent no.2 (complainant) had certain financial transaction. On the ground that the petitioners have cheated respondent no.2, he filed a private complaint. It has culminated in C.C.No.3429/2017 on the file of the VII Additional Chief Metropolitan Magistrate, Bengaluru, wherein the petitioners/accused are charged for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code, 1860. 2. Learned counsel for the petitioners as well as respondent no.2 together submits that the parties have settled their dispute amicably and respondent no.2 is not interested in prosecuting the case against the petitioners herein. They have filed an interlocutory application in this regard and prayed for quashing of the proceedings in C.C.No.3429/2017. Respondent No.2 has also filed an affidavit dated 03.12.2025 in this regard. - 4 - HC-KAR NC: 2025:KHC:50775 CRL.P No. 1271 of 2023 Both are taken on record. Further, the petitioners and respondent No.2 are present before the Court and are duly identified by their respective counsel. 3. It is seen that a misunderstanding in financial transaction between the petitioners and respondent no.2 resulted in C.C.No.3429/2017 and the parties have amicably settled their dispute. The offence alleged against the petitioners are not heinous in nature. Quashing the proceedings as prayed for by both the parties will only result in both the petitioners and respondent no.2 leading their lives peacefully and further the interest of justice would be served. 4. Learned HCGP appearing for respondent No.1 has no objection in quashing the proceedings against the petitioners. Hence the following:- ORDER i. The criminal petition is allowed. ii. The proceedings in C.C.No.3429/2017 on the file of the VII Additional Chief Metropolitan Magistrate, - 5 - HC-KAR NC: 2025:KHC:50775 CRL.P No. 1271 of 2023 Bengaluru, stands quashed insofar as it relates to the petitioners herein are concerned. iii.
