MANOJ, J ------------------------------ W.P.(C) No.28321 of 2016 -------------------------------------------------- Dated this the 28th day of March, 2025 JUDGMENT The writ petition has been preferred challenging Ext.P13, which is a notice of hearing issued based on a representation submitted by the 3rd respondent before the Chief Minister. 2. The issue involved in this case is that while the petitioner was working as Project Officer of the 1st respondent, disciplinary action was taken against the 3rd respondent. In retaliation to that certain allegations of sexual harassment was raised against the petitioner by the 3rd respondent. The matter was considered by both the internal committee and the disciplinary committee, which found in favor of the petitioner. Later, the 3rd respondent has preferred a complaint before the Chief Minister. On the basis of such complaint, a notice was issued along with the complaint preferred by the 3rd respondent to the petitioner calling him to appear before the 2nd respondent on 29.08.2016. Being aggrieved by that the petitioner has preferred this writ petition. W.P.(C) No.28321 of 2016 3 2025:KER:27350 3. On admitting the same an interim order of stay was granted on 26.08.2016. However, it was clarified that if the respondents sought to modify or vacate the interim order, they could bring up the matter. No such attempt was made from the part of the 3rd respondent till this day. Under such circumstances, I deem it appropriate to conclude that neither the petitioner nor the 3rd respondent intends to prosecute the case further. Accordingly, this writ petition is dismissed for non prosecution.
