JUSTICE SANJAY VASHISTH Present: Mr. Manvir Singh Jaidka, Advocate, for the petitioner. Ms. Malvika Singh, DAG, Haryana. Mr. Pankaj Yadav, Advocate, for respondent No.2 (through VC). *** SANJAY VASHISTH, J. (ORAL) The instant petition has been filed under Section 483 of BNSS, 2023, for grant of regular bail to the petitioner, who has been booked for having committed the offence punishable under Sections 420, 467, 468, 471, 120-B of IPC, in FIR No. 565, dated 17.09.2024, registered at Police Station Sector 10, District Gurugram. 2. At the time of hearing on previous dates, this Court was of the view that the dispute could be amicably resolved between the parties. Accordingly, vide order dated 22.08.2025, the matter was referred to the Mediation & Conciliation Centre of this Court for facilitating an amicable settlement. RAJAN 2026.07.16 10:15 I attest to the accuracy and integrity of this document CRM-M-34144-2025(O&M) 2 In order to enable the petitioner to participate in the mediation proceedings, interim bail was granted till 30.09.2025, and the present petition was adjourned to 29.09.2025. Thereafter, despite several opportunities having been granted, petitioner neither complied with the terms of the proposed settlement nor appeared before the Mediation & Conciliation Centre of this Court. Petitioner also failed to pay the agreed amount. Moreover, he continued to enjoy the benefit of interim protection till 04.05.2026, when bailable warrants were ordered to be issued against him. Even today, learned counsel for the petitioner submits that despite making their best efforts, they have been unable to obtain clear instructions from the petitioner, who is neither contacting them nor is in touch with them. Consequently, learned counsel expresses helplessness in the absence of any instructions. 3. Be that as it may, having regard to the conduct of the petitioner, this Court finds no ground to continue the indulgence granted earlier. Accordingly, the present petition is dismissed. 4. It is further directed that the Court concerned shall take appropriate steps for securing the presence of the petitioner, including issuance of non-bailable warrants, if so required, in accordance with law. In case, the Investigating Officer fails to take effective steps for execution of the process, the Superintendent of Police concerned shall ensure compliance and apprise the Court concerned of the action taken.
