Present civil revision petition has been filed under Article 227 of the Constitution of India for issuance of appropriate directions to the Rent Controller, Gurugram to pass appropriate orders to decide the application filed by the respondent under Order 7 Rule 11 CPC in Rent Petition No.RP/89/2023 titled as “Anil Kumar Garg and sons Vs. Suman Gupta”, in a time bound manner. 2. Learned counsel for the petitioner has submitted that the petitioner had filed a petition for eviction of the respondent/tenant and in the said proceedings, the respondent/tenant had filed an application under Order 7 Rule 11 CPC read with Section 151 CPC to which reply was filed by the petitioner on 07.11.2023 and as is apparent from the order dated 02.04.2024, even part arguments were advanced. It is further submitted NARESH KUMAR 2025.07.22 10:13 I attest to the accuracy and integrity of this document/judgement CR-4537-2025 -2- that it is the respondent/tenant who is unnecessarily delaying the proceedings and on 30.01.2025, as recorded by the Rent Controller, the remaining arguments on the application filed under Order VII Rule 11 CPC were heard and a request was made by the counsel for the respondent for filing of authorities. It is stated that it is the said respondent who has not given the authorities and has taken repeated adjournments and the case is now listed for 31.07.2025 and the application under Order VII Rule 11 CPC has not been decided till date. 3. Keeping in view the above-said facts and circumstances, the present revision petition is disposed of with a request to the Rent Controller, Gurugram to decide the application under Order VII Rule 11 CPC, as expeditiously as possible, preferably, within a period of three weeks from 31.07.2025, which is the next date of hearing before the Court. 4. All the counsel appearing before the Rent Controller, Gurugram, are requested to assist the Court in expeditious disposal of the application under Order VII Rule 11 CPC. 5. It is made clear that this Court has not opined on the merits of the said application and the same would be considered independently, in accordance with law.
