Heard Mr. B. J. Ghosh, learned counsel for the petitioner.
2. Pursuant to a Press Notice dated 20.10.2014, the petitioner submitted his bid for the work “Upgradation of SC/SD/PHC to Community Health Centre Phase-I in Barak Valley under CM’s Special Package under Annual Plan 2013-14”. The bid of the petitioner was accepted and the Chief Engineer, PWD (Building), Assam, issued “Issue of notice to proceed with the work” on 07.03.2015 to the petitioner with regard to the said package. The petitioner, accordingly, completed the entire work on 30.09.2021 and handing and taking over also took place on 04.01.2022. A completion certificate was also issued by the Executive Engineer, PWD, Karimganj District Territorial Building Division, which was countersigned by the Assistant Executive Engineer, PWD., Ratabari & Patherkandi. Thereafter, the petitioner submitted his final bill on 15.03.2022 for an amount of Rs.3,29,82,720/-. The Executive Engineer, PWD, Silchar, Sonai & Dholai Territorial Building Division also sent a proposal for revalidation of administrative approval for the said work to the Chief Engineer, PWD Building,
Page No.# 3/3 Health and Education, Assam on 12.09.2022. However, as the said outstanding due has not been paid to the petitioner, the petitioner is before this Court by way of the present writ petition.
3. Mr. B. Gogoi, learned Standing Counsel, PWD and Health Department, on instructions from the respondent No. 7, submits that the outstanding due is an admitted amount, however, he submits that the Authorities may be allowed to re-verify and thereafter, pay the said admitted amount within a specific period of time.
4. After hearing the learned counsel for the parties, this writ petition is
disposed of directing the respondents to have a re-verification with regard to the outstanding dues claimed by the petitioner and thereafter, pay the admitted amount to the petitioner within a period of 4 (four) months from the date of receipt of a certified true copy of this Court’s Order.
5. With the above observations and directions, this writ petition is disposed of.
