Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. Pursuant to earlier order of this Court dated 21.08.2025 respondent no.2-Commissioner of Police, District Prayagraj has filed his personal affidavit and in paragraph 8 of the said affidavit the allegation so leveled is accepted. Paragraph 8 of the affidavit is quoted as under: "8. That the deponent has found S.I. Shri Ritu Raj Singh is prima facie guilty of recovering/seizing the car in question on 16.06.2025 while showing it almost after 24 hours on 17.06.2025. Hence he has been sent to police lines with immediate effect, under the order of DCP City on 08.09.2025, the copy of which is being attached as Annexure No.PA-4 to this personal affidavit." 3. Learned counsel for the petitioner informed that now the vehicle in question has been released by the court. 4. Under such facts of the case, once it is admitted that S.I. Ritu Raj Singh is prima facie guilty of recovering/seizing the car in question, therefore, petition is disposed of with a direction to the respondent no.2- Commissioner of Police, Commissionerate, District Prayagraj to hold a full-fledged enquiry against Sub Inspector Ritu Raj Singh in accordance with the Uttar Pradesh Government Servants (Discipline and Appeal) Rules, 1999 within three months from the date of production of a certified Versus Counsel for Petitioner(s) : Aditya Vishal Chaurasia, Diwan Saifullah Khan Counsel for Respondent(s) : C.S.C. Deepak Chaurasiya .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) copy of this order and outcome of the enquiry shall also be informed to the petitioner-Deepak Chaurasiya.
