Side) for R-1 ORDER This Writ Petition (Criminal) is filed praying to issue a Writ of Mandamus to direct the first respondent to consider the petitioner's complaint, dated Page No. 1 / 4 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.393 of 2025 07.07.2025 and to provide necessary Police protection to perform the Aadi festival to the A/M Shri Karumariyamman Temple from 29.07.2025 to 08.08.2025. 2. Brief facts that led to the filing of the Writ Petition, are stated hereunder: The petitioner and four others have jointly purchased the land in S.No.53/7, which extends to 931 Sq.Fts. in the name of Arul Mighu Shree Karumariyamman Temple on 31.10.2011 and it was duly registered with Sub- Registrar Office, Thatagapatti and its Document Number is 7233/2011. Thereafter, they had constructed the said Temple in the year 2007, though it was already existing in the form of a small statue style. Subsequently, the God had been worshipped by all the communities without any differences. They have been celebrating the Aadi festival every year. However, a Committee was formed led by the petitioner and four others and the administrative work of the Temple was also maintained by the said Committee. The second respondent usurped the amount of Rs.65,000/- from the Temple funds and it was found out and forced him to re-pay the amount. Thereafter, the second respondent is continuously creating trouble during the Aadi festival from the year 2022 with the name of caste. Therefore, they have arranged all the preparatory works to perform the 21st year Aadi festival for this year. The invitations were prepared and invitations were made inviting celebrities, collected funds from the public and also the public. The Temple festival starts from 29.07.2025 and ends on Page No. 2 / 4 https://www.mhc.tn.gov.in/judis W.P.(Crl).No.393 of 2025 08.08.2025. In such circumstances, the second respondent again created trouble to do the Temple festival preparatory work. Hence, the petitioner lodged a complaint to the first respondent on 07.07.2025 and requested to take necessary action against the second respondent and also to request to provide necessary Police protection to perform the Temple festival. As no steps were taken by the first respondent, the present Writ Petition is filed for the relief stated supra. 3. Based on the undertaking given by the learned Government Advocate (Criminal Side) appearing for the first respondent, the first respondent is directed to consider the representation of the petitioner, dated 07.07.2025 and after giving an opportunity of hearing to the parties, the first respondent is directed to pass appropriate orders on the said representation and dispose of the same on merits and in accordance with law, expeditiously. 4.
