The submission of learned counsel for the applicant is that applicant had lodged an F.I.R. against the opposite party nos. 2 to 4 and three others on 19.03.2020 and after lodging of the F.I.R. police investigated the matter and submitted charge-sheet against the opposite party nos. 2 and 3 and filed final report in favour of the opposite party no. 4 on 18.06.2020, upon which learned trial court rejected the final report filed against the opposite party no. 4 and took congnizance and committed the matter to the Sessions for trial. Trial court framed the charges on 16.05.2022 and put the case for evidence and since then the matter is pending and accused persons are lingering the matter and trial court is not interest to decide the same, therefore a direction to the
trial court may be issued to conclude the trial. 4. Per contra, learned AGA submitted that after framing of charges the case is on evidence stage and order sheet annexed with the instant application shows that proceedings is going on and trial court has also imposed cost for getting adjournment upon the accused persons, therefore, no interference is required by this Court in the instant matter. 5.
Considered the submission advanced on behalf of both parties and having perused the material on record, it is evident from the record that trial is at the stage of evidence and proceedings are going on, even trial court had imposed a penalty for seeking adjournment, at this stage, this court does not see any merit in the instant application and therefore, request for a direction to the trial court for concluding the trial expeditiously is refused. 6.
