ORAL ORDER
Aggrieved by the
order passed in I.A.No.III in M.C.No.102/2022 dated 07.08.2023 by the Principal Judge, I Additional Family Court, Hassan, whereby the Family Court had granted interim maintenance of an amount of Rs.15,000/- per month to the respondent/wife, the petitioner/husband is before this Court.
2. The parties are referred to as husband and wife for the sake of convenience.
3. Learned counsel appearing for the petitioner/husband submits that the wife is working and getting salary around Rs.50,000/- per month and that aspect was not disclosed by the wife. It is submitted that the husband is working as a Constable in CRPF and now he is suffering with cancer and taking treatment in CRPF hospital. It is submitted that in fact, the husband has obtained loan of Rs.11,00,000/- in order to purchase 5 guntas of land in the name of the wife. It is submitted that the Family Court has failed to consider all these aspects.

4. Though notice is served on the respondent, no vakalath is filed on behalf of the respondent.
5. Having heard the learned counsel for the petitioner, this Court has perused the material on record. Particularly considering the fact that the petitioner is suffering with cancer, this Court deems it appropriate to reduce the maintenance from an amount of Rs.15,000/- to Rs.10,000/- per month. Hence, this Court is passing the following order:
ORDER i. The
order passed in I.A.No.III in M.C.No.102/2022 dated 07.08.2023 by the Principal Judge, I Additional Family Court, Hassan, is modified and the maintenance is reduced from an amount of Rs.15,000/- to Rs.10,000/- per month. ii. Accordingly, the writ petition is disposed of. iii. All I.As. in this petition shall stand closed. SD/- (LALITHA KANNEGANTI) JUDGE
