Counter affidavit filed by the learned A.G.A. is taken on record. 2. Heard learned counsel for the petitioner, Sri Rishi Chaddha, learned AGA for the State, and perused the record. 3. The present writ petition has been filed by the petitioner for the following reliefs:- "i. Issue a writ, order or direction in the nature of mandamus directing the respondent authorities to fair and impartial the investigation of the Case Crime No. 0239 of 2024, under Sections 191(2), 191(3), 190, 115(2), 352, 76, 109, 125, 131 of B.N.S. and 3(1)(da), 3(1)(dha) and 3(2)(5) of SC/ST Act, Police Station Rabpura, District Gautam Buddh Nagar. ii. Issue any other writ, order or direction that this Hon'ble Court may deem fit and proper in the circumstances of the case. iii. Award the cost of the petition to the petitioner." 4. Learned counsel for the petitioner has submitted that the petitioner is the first informant in the present case and though the F.I.R. in the instant case has been registered on 15.11.2024, yet the police is not investigating the case in fair and impartial manner. 5. In view of the above, the petitioner may move an application before the Versus Counsel for Petitioner(s) : Jay Prakash Yadav Counsel for Respondent(s) : G.A. Sheesh Pal Singh .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) respondent no. 2- Commissioner of Police, Gautam Buddh Nagar highlighting his grievance and seeking fair and impartial investigation and if such an application is moved by the petitioner, the respondent no. 2- Commissioner of Police, Gautam Buddh Nagar shall ensure the fair, impartial and expeditious investigation in the present case. 6.
