Choudhury, learned senior counsel, assisted by Mr. R.A. Choudhury, learned counsel appearing for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State of Assam. This is an application under section 482 of the BNSS, 2023 praying for Page No.# 2/2 grant of pre-arrest bail to the petitioner in respect of Jogighopa P.S. Case No. 02/2025, under section 69/87/115(2)/76 of the BNS, 2023. The informant girl was having a relationship with the present petitioner for a long period of 3 (three) years. On 19.12.2024, at about 6:30 PM, the petitioner allegedly took the victim girl to his house for the purpose of marriage. When she reached the house of the petitioner, his mother and brother have assaulted her causing injury to her. After considering the submissions made by the learned counsel for the both sides in the light of the allegations brought in the FIR, this Court is of the opinion that on the aforesaid allegation, the petitioner does not deserve to be detained in custody. Accordingly, this pre-arrest bail application is allowed. Therefore, it is hereby directed that in the event of arrest of the petitioner, namely, Afjalur Rahman, in connection with Jogighopa P.S. Case No. 02/2025, the arresting authority shall release him on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the arresting authority. If require, the petitioner shall cooperate with the Investigating Officer. With the aforesaid direction, this pre-arrest bail application stands disposed of. JUDGE Comparing Assistant
