IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.35858 of 2025 Giridhari Higher Secondary School, Pattamundai …. Petitioner Mr. A.K. Mohanty, Advocate -Versus- State of Odisha & Others …. Opposite Parties Mr. S.B. Mohanty, AGA CORAM: JUSTICE DIXIT KRISHNA SHRIPAD Order No. 01. ORDER 16.12.2025 Petition prayer reads as under: “Under the above facts and circumstances of the case, the Petitioner fervently prays before this Hon'ble Court to admit this Writ Petition and call for the relevant documents from the Opp.Parties and after hearing the learned Counsel of Opp.Parties concerned to issue the permission certificate in favour of the proposed Special School name i.e. Giridhari Higher Secondary School for the Divyanga for establishment vide Annexure-6 under provision of Social Security & Empowerment of Persons with Disabilities (SSEPD) Department Resolution dated 06.06.2022 ,Govt. of Odisha for the academic year 2026-27;” 2. Learned counsel for the Petitioner draws attention of the Court to Petitioner’s representation dated 11.11.2025, a copy whereof avails at Annexure-6, wherein the permission is sought for at the hands of the jurisdictional authorities for establishing a new special Higher Secondary Institute(IX-XII) for hearing & visually impaired persons, for the academic year 2026-27. Counsel submits that if a direction is issued for consideration of the subject representation in accordance with law and within a time bound manner, justice would be meted out to his client. This is fair. 3. Learned AGA-Mr. Mohanty appearing for the OPs submits that representation of the kind cannot be mandatory to be considered, inasmuch a host of factors entered the fray of decision making and therefore, matter should be left open to the OPs. Having so contended, now, he agrees to instruct jurisdictional OPs to look into the grievance of the Petitioner, as has been aired in the subject representation, in a time bound way, if all contentions are kept open. This is fair enough. In the above circumstances, writ petition is disposed off. Time for consideration of the subject representation and informing result of such consideration to the Petitioner in writing, is eight weeks. All contentions are kept open. It is open to the answering Opposite Parties to solicit any information or documents from the side of the Petitioner, as required for taking a decision on the subject representation. However, in that guise delay shall not be brooked. Now, no costs. Web copy of this order to be acted upon by all concerned. ( Dixit Krishna Shripad ) Judge Madhusmita Designation: Jr. Stenographer
