05/ 21.04.2025 Heard Mr. Sanjit Kumar, learned counsel appearing for the petitioner and learned A.C. to A.G. for the State.

This petition has been filed under Article 227 of the Constitution of India, wherein prayer has been made for setting aside the order dated 21.02.2024, passed in Original Suit No. 630 of 2021, by the learned Additional Principal Judge, Family Court, Ranchi.

Learned counsel appearing for the petitioner submits that a petition under Section 9 of the Hindu Marriage Act has been instituted by the petitioner for restoration of conjugal life, which is still pending before the learned court and during the pendency of the said petition, wife of the petitioner has filed a petition for interim maintenance, wherein the learned court has been pleased to grant interim maintenance of Rs. 3,000/- per month. He submits that the petitioner is ready to keep his wife with all dignity, in spite of that the learned court has passed the said order.

Only interim maintenance has been provided to the tune of Rs. 3,000/- per month and the main case is still pending and further

maintenance is the right of the wife and all the grounds taken by the petitioner, can be argued by the learned counsel appearing for the petitioner in the main original suit, which is still pending before the learned court.

In view of the above, no case of interference is made out. As such, this petition is dismissed with the liberty to the petitioner to take all the grounds before the learned court where the main matter is still pending.
