JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER This petition is filed by the husband and in-laws and relatives seeking quashing of the proceedings pending in C.C.No.1161/2023 for the offence punishable under Section 143, 147, 323, 504, 506 read with Section 149 of Indian Penal Code, 1860. 2. Today, a joint compromise petition has been filed, duly signed by all the parties. The 2nd respondent/complainant, who is the wife of the 1st petitioner/accused No.1, is present before this Court. The husband has handed over a Demand Draft for a sum of - 4 - HC-KAR NC: 2025:KHC:39024 WP No. 10735 of 2024 Rs.31,00,000/- (Rupees Thirty-One Lakhs only) to the complainant in open Court. 3. On being queried, the complainant submits that she has voluntarily entered into an amicable settlement with her husband. Both parties have agreed to dissolve their marriage by mutual consent in M.C. No.24/2016 pending before the Principal Family Court, Kolar. 4. In view of the aforesaid settlement, and the fact that the complainant has received a sum of Rs.31,00,000/- towards full and final settlement of all her claims, the 2nd respondent/complainant has no objection to the proceedings being quashed. She has expressed her consent to enable both parties to record the terms of compromise in the pending matrimonial proceedings. 5. Recording the said submission and the fact that the dispute between the husband and wife has been amicably resolved, and the amount of Rs.31,00,000/- has been duly paid in full and final settlement, this Court is of - 5 - HC-KAR NC: 2025:KHC:39024 WP No. 10735 of 2024 the view that continuation of the criminal proceedings would serve no useful purpose. Hence, to secure the ends of justice and to prevent abuse of the process of law, this Court deems it appropriate to exercise its inherent powers under Section 482 of the Code of Criminal Procedure, 1973. 6. Accordingly, this Court proceeds to pass the following: ORDER i. The criminal petition is allowed. ii. The proceedings pending in C.C.No.1161/2023 on the file of the Principal Civil Judge and JMFC..
