Heard learned counsel for the petitioner, learned AGA for the State and perused the record. 2. The instant writ petition has been filed by the petitioner for the following relief: "(i) Issue a writ, order or direction in the nature of mandamus directing and commanding the respondent No. 2 to direct the respondent No. 3 to conduct the investigation and take coercive/necessary action against the accused/respondent Nos. 4 to 7 and arrest them in pursuance of First Information Report dated 4.7.2023, in Case Crime No. 327 of 2023, under Sections 419, 420 IPC, P.S. Kotwali, District- Ghazipur lodged by the petitioner/complainant against the accused/respondent Nos. 4 to 7 (contained in Annexure No. 1 to this writ petition). (ii) Issue any other suitable writ, order or direction as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case. (iii) Award the cost of the writ petition to the petitioner/complainant." 3. Learned counsel for the petitioner submits that the petitioner is the first informant in the present case and though the FIR in the instant case has been registered on 4.7.2023, yet the police is not investigating the case in fair and impartial manner. 4. In view of the above, the petitioner may move an application before the Superintendent of Police, Ghazipur, District-Ghazipur, highlighting his grievance and seeking fair and impartial investigation and if such an application is moved before the Superintendent of Police, Ghazipur, District-Ghazipur, the Superintendent of Police, Ghazipur, District-Ghazipur/respondent no. 2 shall ensure the fair, impartial and expeditious investigation in the present case. 5.
