IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.35539 of 2025 Smt. Nalini Prava Barik …. Petitioner Mr. K.K. Swain, Advocate -Versus- State of Odisha & Others …. Opposite Parties Mr. J.K. Khandayatray, ASC CORAM: JUSTICE DIXIT KRISHNA SHRIPAD Order No. 01. ORDER 12.12.2025 Petitioner’s representations at Annexure-17 series aired the grievance that release of grant-in-aid in her favour ought to have been under the Grant-In-Aid Order, 2008 and not under the Grant-In-Aid Order, 2014. 2. Learned counsel for the Petitioner submits that the mistake occurred because of the pendency of OJC No.15216 of 1997 filed by one Shri Sukant Kumar Jena and that the same having been withdrawn on 29.03.2014, there is no impediment for relief which the Petitioner has sought for in the representation and in the petition as well. He also submits that if a decision is taken on the subject representations in accordance with law, his client would be satisfied. 3. Learned ASC-Mr. Khandayatray appearing for the OP Nos.1 to 4, notice to OP No.5 having been dispensed with, submits that there would no difficulty for instructing OP No.3 to look into the grievance of the Petitioner, as has been aired in the subject representation, if all contentions are kept open and a reasonable period is prescribed for accomplishing the task. He also expects cooperation from the side of the Petitioner, and Petitioner’s counsel is agreeable to do the same. In the above circumstances, writ petition is disposed off. Time for consideration of the subject representation and informing result of such consideration to the Petitioner in writing, is eight weeks. All contentions are kept open. It is open to the answering OP No.3 to solicit any information or documents from the side of the Petitioner, as required for taking a decision on the subject representation. However, in that guise delay shall not be brooked. Now, no costs. Web copy of this order to be acted upon by all concerned. ( Dixit Krishna Shripad ) Judge Madhusmita Designation: Jr. Stenographer
