STATION HOUSE OFFICER WOMEN POLICE STATION PUTTUR D.K -574201 …RESPONDENTS (BY SRI.MAHANTESH SHETTAR, AGA) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE IMPUGNED ENDORSEMENT DATED 13.08.2021 ISSUED BY R3 AS PER ANNEXURE-A AND ETC. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER In this writ petition, the petitioner is assailing the endorsement dated 13.08.2021 (Annexure-A) issued by respondent No.3. - 3 - HC-KAR NC: 2025:KHC:47684 WP No. 7168 of 2022 2. Having heard the learned counsel appearing for the parties, I have carefully examined the impugned endorsement at Annexure-A, wherein the warrant was issued by the Principal Civil Judge and J.M.F.C., Puttur, D.K against the petitioner herein. Since the said warrant was not recalled and the same is in force and as such, the respondent - authorities have issued the endorsement as per Annexure-A. 3. In this regard, a perusal of Section 70(2) of the Code of Criminal Procedure, 1973 envisages that every warrant shall remain in force until it is cancelled by the competent Court. Undisputedly, in the present case, the earlier warrant issued by the Court was not cancelled despite the fact that the petitioner has got the order on the petition filed under Section 438 of Cr.P.C, enlarging him on bail and in that view of the matter, I do not find any merit in the writ petition. 4. However, insofar as the arguments advanced by the learned counsel appearing for the petitioner with - 4 - HC-KAR NC: 2025:KHC:47684 WP No. 7168 of 2022 regard to any complaint to be made against the respondent - authorities herein, it is open for the petitioner to approach the State Police Complaint Authority for redressal of his grievance. With these above observations, the writ petition stands disposed of. Sd/- (E.S.INDIRESH) JUDGE NBM List No.: 1 Sl No.: 2
