Mr. Akshay Pradhan, Advocate for the petitioner. Mr. Suyash Pant, Standing Counsel for the State. By means of the instant petition, the petitioner seeks the following reliefs:- (i) To issue a writ, order or direction in the nature of mandamus directing the Respondent No.2 and 3 to take a decision on the representations of the Petitioner dated 30.09.2024, 14.10.2024 and
01.05.2025. (Annexure No.1); Or Issue a writ in the nature of mandamus directing the Respondents Nos. 2 and 3 to take immediate steps to remove the unlawful encroachments made upon the government/natural pond situated in Khasra Nos. 356, 361 and 526 of Village Mundakhera Kalan, Tehsil Laksar, District Hardiwar, by Respondent Nos. 5 to 8, with the connivance and active assistance of Respondent No.4. (ii) Issue any writ, order or direction, which this Hon’ble Court may deem fit and proper under the facts and circumstances of the case. (iii) Award the cost of the petition in favour of the Petitioner. Heard. Learned counsel for the petitioner submits that various persons have encroached upon the common utility land of the village, for which multiple representations were given by the
petitioner to the respondent nos. 2 and 3, but it has yet not been decided. He seeks directions that the respondent no. 2, District Magistrate, Haridwar, and respondent no.3, Sub Divisional Magistrate, Laksar, may be directed to take immediate steps for removal of the encroachment. Learned State Counsel, under instructions, submits that proceedings for eviction has already been initiated against some persons; a team of officers have already been constituted for that purpose. The Court takes on record the statement given by learned State Counsel. In view of the statement given by learned State Counsel, nothing survives in this writ petition. It stands disposed of, accordingly.
